Daily Quake Forecast Purchaser's Agreement  
                               
Disclaimer of Liability and Indemnification
This website provides earthquake forecast information.   You are purchasing the daily earthquake forecast for one full year in the amount of $1,000.00 per day (total amount $365, 000.00) for a city, region, state or country that you must specify in the comments section of the purchase form on the next screen if you agree to the conditions below. All of the forecasts in this contract will or may, at the purchaser's discretion, be published on the web for all the world to view and use at a special web address to be set up by this forecaster as a direct link from www.earthquakeforecast.com and may be credited to the purchaser, if so desired. This purchase is cancelable by the purchaser at any time commencing if and when the forecast is incorrect on any one variable of time, location or magnitude in any single forecast provided in this contract, upon immediate notification, within 3 days, by the purchaser.  All Earthquake Forecasts sold to date have been 100% correct. Use at your own risk!   You and all users must recognize and agree that no one can forecast or predict earthquakes with 100% accuracy in time, location and magnitude at all times and that this site presents a highly experimental method of forecasting  with varying accuracy rates and no standards exist.  You and all users  must make your own decisions to evacuate, purchase insurance, supplies and other matters, based on your personal situation, for which neither www.earthquakeforecast.com, www.hurricaneforecast.com, EarthquakeForecast Services, nor any associates, affiliates, nor employees of the company accept liability in respect of any loss, damage, death, injury or other occurrence arising from the provision of any information provided on this website.  Additionally, you and all users must agree to hold the forecaster, Mary Ann Slaby, www.hurricaneforecast.com,  www.earthquakeforecast.com, the company, EarthquakeForecast Services, the parent company, Synthetic Hydrocarbons, the internet service provider, America Online, the internet host, Hypermart, and Go2Net, the merchant provider and processing services, Charge.com, Network 1 Financial, and EFT Secure, and all parties associated with these forecasts harmless against all liability, including death, injury, damage of any kind, for any mistake, use, misuse omission or error, suitability of purpose, service, advise of insurance or any other matter included in the forecast itself or website, delay or failure to provide service, server failure, email failure or delay, in order to purchase this earthquake forecast service product.  Should any dispute arise after the purchaser (including his representatives, attorneys, family, or counsel) agrees to these conditions, the purchaser and all users waives all claims of liability against the www.earthquakeforecast.com, www.hurricaneforcast.com, EarthquakeForecast Services and any above mentioned associates and affiliates and the purchaser further agrees to pay all attorney fees, all court costs,  preparation and defense fees of the Hurricane Forecast, EarthquakeForecast Services and those of any other parties, associate, or affiliates in any ensuing action.
Don't Be Stupid: Evacuate under Official Warning

There are no guarantees, explicit nor implicit, in these forecasts and/or predictions.   The earthquake forecast information is provided for use in assisting in the management of individual safety and property protection by allowing preparation through expectation that there is a high probability that the event will occur during the time, location and magnitude range specified.   At any time these earthquake forecasts should not be relied upon over officially disseminated warnings and information by the government, like the USGS,  FEMA and/or Homeland Security.

The earthquake forecast bears the ownership and/or copyright of the information contained herein and such information may not be reproduced in any form without paying the proper user fees and without obtaining the prior written authority of the Earthquake Forecast Service and www.earthquakeforecast.com, and, if quoted, the source must be acknowledged.
Refund Policy
You get a full refund of the $1,000.00 per day purchase price if the earthquake values do not fall within the ranges and limits of the forecast sent to you (by email) or published on the web (if, at your request). to commence with the incorrect forecast; it is not retroactive.  You must notify within 3 days of the incorrect forecast of your intent to cancel and previous daily correct forecasts'  fees are not refundable.  A sample forecast has the following format and consists of all three variables:

Earthquake Forecast Time:  12/24/04 +/- 3 days (12/21/04 - 12/27/04) The Sumatra earthquake occurred on 12/26/04,  thus this forecast would be accurate.

Earthquake Forecast Magnitude: 8.0 +/- 1 on the open ended Richter Scale (7.0-9.0) as reported by any seismological agency at the forecaster's choosing.  Since the Sumatra Quake was reported to be an 8.9, 9.1 depending on the seismology reporting services, this forecast would be within the limits and correct.  EMSC, the USGS, or Kandilli are usually used in the verification, but others are also used.. 

Earthquake Forecast Location: 0oN/90oE  +/- 15o radius (15oN-15oS/75oE-105oE) The Sumatra Quake epicenter was at 3.3oN/95.98E so the epicenter would fall within the limits of the forecast and would be correct.

You get a full refund if all three parameters are not correct simultaneously, to commence with the incorrect forecast and upon notification within 3 days!   The forecast will be e-mailed and/or (if at your request) published to the web for the city, region, state or country stipulated in the comments section on the next link.  There are no refunds for any other reason.
